Mark R. Osherow is an American attorney and Florida Bar board-certified business litigation lawyer based in Boca Raton, Florida.[1][2] He is the founding member of Osherow, PLLC, a law firm that focuses on business and commercial litigation, as well as mediation and arbitration.[3] He has been recognized in the Florida edition of Super Lawyers in the field of business litigation each year from 2007 through 2026.[1]

Early life and education

Osherow received a Bachelor of Arts degree from the University of Pennsylvania in 1985.[4] He earned his Juris Doctor from the Benjamin N. Cardozo School of Law at Yeshiva University in 1988.[4] During his early career he focused on civil and commercial litigation.[5]

After law school, Osherow joined private practice in Florida, working in civil and commercial litigation at several law firms.[5] He became a partner at Katz Barron and later served as of counsel at Broad and Cassel, where he handled business, real estate, construction, and commercial disputes in state and federal courts.[4][5]

Osherow founded Osherow, PLLC in Boca Raton, Florida.[3] The firm concentrates on business and commercial litigation, representing companies, business owners, and individuals in disputes involving contracts, business torts, shareholder and partnership issues, restrictive covenants, real estate, construction, and related areas.[3][6] He has served as first-chair trial counsel in multiple cases and has represented clients in mediations, arbitrations, and appeals.[4][7]

His cases have included matters involving noncompete and nonsolicitation agreements, trade secret claims, alleged fraud and misrepresentation, disputes among business partners and shareholders, real estate and title-related issues, construction defect and construction-related insurance disputes, and employment and wage-and-hour matters.[4][1] He has also handled probate, trust, and fiduciary disputes related to wills, trusts, and estate planning arrangements.[4]

Mediation and arbitration

Osherow is a Florida Supreme Court Certified Circuit Civil Mediator and also serves as an arbitrator.[8][7] In addition to his role as an advocate, he acts as a neutral in business and civil disputes, conducting mediations and arbitrations in commercial, real estate, employment, and probate-related matters.[8][3] His mediation and arbitration work focuses on helping parties assess litigation risks and pursue negotiated resolutions.[6]

Board certification and admissions

Osherow is board certified by The Florida Bar in business litigation.[2] He has served on The Florida Bar's Business Litigation Certification Committee, including as chair and vice chair.[9]

He is admitted to practice law in Florida, Connecticut, New York, and New Jersey.[6][1] He is also admitted to practice before the United States District Courts for the Southern, Middle, and Northern Districts of Florida, the United States Court of Appeals for the Eleventh Circuit, and the Supreme Court of the United States.[6][5]

Professional activities

Osherow has been active in bar organizations in South Florida and statewide.[6][9] He has served as president and as a member of the board of directors of the South Palm Beach County Bar Association.[6] Within The Florida Bar, he has served on the Business Litigation Certification Committee, the Standing Committee on the Unlicensed Practice of Law, the Legal Specialization and Education Committee, and the editorial board of The Florida Bar Journal.[9][4] He has also been associated with the Craig S. Barnard American Inn of Court in Palm Beach County.[6]

Osherow has written and spoken on topics related to business litigation, evidence, and professional development, including the use of archived internet content in litigation and advice to younger lawyers.[10][11]

Honors and recognition

Osherow has been recognized in the Florida list of Super Lawyers in business litigation every year from 2007 through 2026.[1] He has also been listed in The Best Lawyers in America in business litigation and in Florida Trend's "Florida Legal Elite".[4][1] Peer-review ratings have noted his legal ability and professional conduct.[5]

Based in Boca Raton, Osherow represents clients in South Florida and elsewhere in Florida, including Palm Beach, Broward, and Miami-Dade Counties.[3][12] His clients have included closely held and privately held companies, business owners and executives, professionals, and individuals involved in business, real estate, and fiduciary disputes in industries such as healthcare, hospitality, technology, and professional services.[4][6]
